Ms. Marques has a Master of Arts in Clinical Psychology with a concentration in the child development (0-7) with a strong background in early childhood development and education, and special services. Ms. Marques is a consultant, a former chairperson for a non-profit organization, a bilingual mental health counselor, a supervisor for a bilingual Early Head Start program, a Health Services Manager for an Early/Head Start Program of Excellence, and a project developer/grant writer for daycare and Montessori school programs. Ms. Marques is also a mother of two and a grandmother of three. She provided numerous in-house and outside training per areas of expertise; she is a Lifetime member of Ashoka Innovators for the Public.

C.H.I.L.D. Protocol™ position on the issue of assessment content disclosure and the release of assessment results takes into consideration access rights to assessment information and results under the United States’ Health Insurance Portability and Accountability Act (“HIPAA”). C.H.I.L.D. Protocol™ has consistently applied and continues to keep its non- disclosure policy of its assessment items, scales response/answer sheets (which include specific assessment tools, instructions, tables, descriptive summaries), and other materials, which is consistent with privacy legislation in United States. The HIPAA Privacy Rule provides that individuals have a qualified right of access to individually “identifiable health information” kept in their “designated record set” by health care providers covered by HIPAA.
C.H.I.L.D. Protocol™ advises that Assessment Materials, such as assessment protocols, items, scoring criteria, and descriptive summaries by themselves are not “identifiable health information” and are thus not releasable. Since HIPAA does not say that the requested information should be available in a form that is understandable to the client, C.H.I.L.D. Protocol™ recommends that all health care providers keep copies of completed patient reports so that the parent/guardian may gain access to the report, upon obtaining written consent.
Even if Assessment Materials are considered releasable, Section 1172(e) states that health care providers do not have to disclose any information that is a trade secret or confidential commercial information. The U.S. Department of Health and Human Services (HHS) has long confirmed that a client’s access request is subject to the trade secret exemption. Any requirement for disclosure of protected health information by the Privacy Rule is subject to Section 1172(e) of HIPAA, ‘Protection of Trade Secrets.’ As such, we confirm that it would not be a violation of the Privacy Rule for a covered entity to refrain from providing access to an individual’s protected health information, to the extent that doing so would result in a disclosure of trade secrets. C.H.I.L.D. Protocol™ has confirmed that the trade secret exemption applies to proprietary Assessment Materials. C.H.I.L.D. Protocol™ recommends that its Assessment Materials are proprietary, copyrighted, confidential commercial information, analogous to trade secrets, and treats and protects them accordingly.
Assessment Materials thus fall under the exception to release to ensure the ongoing safeguarding of such material. To provide clients with assessment items, scoring criteria, and other assessment protocols would be to reveal trade secret information on which the scores are based and would make the Assessment Materials useless. Studies confirm that if assessment items and assessment protocols were readily available, the integrity of the assessment and scoring model could be compromised and would harm the public.
The assessment publishing industry considers Assessment Materials to be confidential information and trade secrets and protects these accordingly. To secure and protect Assessment Materials, C.H.I.L.D. Protocol™ enforces qualification standards which prohibits purchasers from altering, copying, and releasing the assessment to others who are not qualified to interpret the results or who do not have the same ethical obligations to maintain assessment security, nor has C.H.I.L.D. Protocol™ permitted its licensees, distributors, or employees to alter and disclose such material. Furthermore, it is in the best interest of the public to protect the validity and integrity of Assessment Materials. Thus, health care providers may refrain from supplying access to and copies of a client’s identifiable health information, as far as to reveal client’s identifiable data, valuable trade secrets, and propriety information. It is C.H.I.L.D. Protocol™ recommendation to obtain client consent prior to releasing client’s summary information.

Since most of the C.H.I.L.D. Ms. Marques is a consultant, a former chairperson for a non-profit organization, a bilingual mental health counselor, a supervisor for a bilingual Early Head Start program, a Health Services Manager for an Early/Head Start Program of Excellence, and a project developer/grant writer for daycare and Montessori school programs. Ms. Marques is also a mother of two and a grandmother of three. She provided numerous in-house and outside training per areas of expertise; she is a Lifetime member of Ashoka Innovators for the Public.
